If Information isn’t marked, does that mean it isn’t CUI?

In short, no. If the information is created or received from the government, whether directly or indirectly (e.g., as a subcontractor), and it falls under the definition of CUI, then it is still CUI. We’re all human, and we make mistakes. If your organization receives information that you think may be CUI, ask your prime contractor or the government for clarification. Remember, we’re in this together and the goal is to protect the government’s information.
